1. Introduction

Welcome to dbAPIator. These Terms and Conditions govern your use of our platform and services. By accessing or using dbAPIator, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the service.

2. Definitions

Service Level Agreement (SLA)

As a backend-as-a-service provider, we commit to a 99.9% uptime for our Service. This excludes scheduled maintenance windows, which will be communicated in advance whenever possible. In the event that we fail to meet this uptime commitment, eligible customers may request service credits in accordance with our SLA policy, available upon request.

5. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Webwerks SRL and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our Service without prior written consent.

6. User Content

You retain full ownership and control of any content you submit to or process through the Service. We do not claim any ownership rights to your content.

We do not access, use, reproduce, modify, or distribute your content except as strictly necessary to provide the Service functionality you explicitly request. Your content is considered private and confidential.

You are responsible for:

  • Ensuring you have the necessary rights to the content you process through our Service.
  • Complying with applicable laws regarding your content.

As part of our services, we provide data backup to help protect your content from accidental loss. However, we recommend maintaining your own backups as an additional precaution.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive to maintain our 99.9% uptime commitment as outlined in our Service Level Agreement, we do not guarantee that the Service will be completely uninterrupted, secure, or error-free, or that all defects will be corrected. Your sole remedy for any service availability issues is outlined in our SLA policy.

Except as expressly provided in our SLA, we make no warranties regarding the performance, reliability, or availability of the Service.

10. Indemnification

You agree to indemnify, defend, and hold harmless dbAPIator and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your Account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
